Who needs SAP services?

The Federal Highway Administration of the United States Department of Transportation requires drivers who hold Commercial Driver’s Licenses to undergo drug and alcohol testing. Drivers who must be tested include anyone who drives a motor vehicle:

  • with a gross combination weight rating 26,001 or more pounds, inclusive of a towed unit with a gross vehicle weight of more than 10,000 pounds;
  • with a gross vehicle weight rating of 26,001 pounds;
  • designed to transport sixteen or more passengers or
  • of any size that is used to transport hazardous material that requires the vehicle to be placarded under the hazardous materials regulations.

Additionally, a company is required to test all employees who are employed in positions designated as safety-sensitive. A safety-sensitive position is defined as any position in which in the course of performance of the designated tasks, there is the possibility that the worker, a co-worker, or the public could be injured.

Any employee or driver who tests positive for drugs or alcohol must have an assessment by a Substance Abuse Professional (SAP). An SAP meets the professional and training qualifications required by the Department of Transportation. A Licensed Alcohol and Drug Counselor without Department of Transportation qualifications is not sufficient.
